29 CFR 1910.95(g)(1):The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: On January 3, 2023 a continuing, effective hearing conservation program including the elements of audiometric testing was not administered for instances such as, but not limited to: a. baseline audiometric testing for employees exposed to noise levels above the action level of TWA 85.0 dba within first year of employment using mobile test van exception exposing employees to undetected hearing loss. b. annual audiometric testing conducted on employees exposed to noise levels above the action level of TWA 85.0 dba exposing employees to undetected hearing loss.

29 CFR 1910.95(g)(6): At least annually after obtaining the baseline audiogram, the employer had not obtained a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels : On or about January 3, 2023, employees were exposed to continuous noise levels above the OSHA action level time weighted average of 85.0 decibels and employer had not ensured employees had annual audiometric testing conducted exposing employees to undetected hearing loss: a. Employee #1, Lapping Table Operator working in Cell B, was exposed to noise at 92.8% of the permissible daily dose, or an average sound level of 90.0 decibels, as measured over 448 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 89.5 decibels accounting for the period of 32 minutes unmonitored. b. Employee #2, Lapping Table Operator working in Cell B, was exposed to noise at 66.1% of the permissible daily dose, or an average sound level of 87.6 decibels, as measured over 444 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 87.0 decibels accounting for the period of 36 minutes unmonitored.
