29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   On or About: January 4. 2022 Location: 232 Miller St., Newark, NJ  a) Employees engaged in masonry activities were working from the roof, and exposed to fall hazard approximately 25 feet to the concrete below as guardrail systems, safety net systems, or personal fall arrest systems were not being used.

29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.   On or About: January 4. 2022 Location: 232 Miller St., Newark, NJ   a) Employees accessed a scaffold platform that was more than two feet from the point of access without a ladder system. Employees climbed from the roof down to a suspended scaffold platform without a safe means of access.  Employees were exposed to fall hazards.

29 CFR  1926.451(f)(6):  Scaffolds were erected, used, dismantled, altered, or moved such that they, or any conductive material handled on them, could have come closer than the minimum distances established for specific voltages as set forth in the table in subparagraph (f)(6).  On or About: January 4. 2022 Location: 232 Miller St., Newark, NJ   a) Employees erected a suspended scaffold that less than 3 feet from powerlines.  Employees engaged in masonry activities worked from a suspended scaffold which was erected approximately 3 feet above the unprotected 200 amp, 240 volt power drop. Employees were exposed to electrocution hazard.

29 CFR  1926.451(g)(1)(ii): Each employee on a single-point or two-point adjustable suspension scaffold was not protected by both a personal fall arrest system and a guardrail system:   On or About: January 4. 2022 Location: 232 Miller St., Newark, NJ   a) Employees worked from a suspended scaffold without being protected by both personal fall arrest system and guardrail system. The employer did not ensure that the suspended scaffold had end rails installed and that each employee was using a personal fall arrest system while engaged in masonry activities.
