OSH ACT of 1970 Section (5)(a)(1)  Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to pinch point and amputation hazards caused by material being worked on by a press.  On or about December 29, 2022: Employees engaged in steel fabrication activities at the Modine Manufacturing Company located at 1502 South Country Club Drive Jefferson City, Missouri 65109, were exposed to pinch point hazards. The employer did not ensure employees were adequately protected from amputation hazards while operating a press break to produce and manufacture parts from steel sheet metal.  Feasible means of abatement includes reprogramming the press brake involved in the accident and all substantially similar press brakes so that the bend occurs on the inside rather than the outside of the press. Reprogramming should abate the hazard of having an operator possibly placing their hands over the product, which would create the possibility of a pinch point outside the point of operation of the press. Retraining and update all press break operators with new press brake programming, product bending, and procedural changes, as well as utilizing sheet followers to help support the product being worked on.
