Specifically the company was allowing step ladders to be used incorrectly, step ladders were kept in a closed position and leaned against warehouse aisles to retrieve boxes.

(b) On or about January 5, 2023, the employer failed to ensure all employees operating an order picker had successfully completed a valid order picker training course, to ensure they were competent to safely operate an order picker. (c) On or about January 5, 2023, the employer failed to ensure all employees operating a power jack lift had successfully completed a valid power jack lift training course, to ensure they were competent to safely operate a power jack lift.

29 CFR 1910.178(q)(7):Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a) On or about January 5, 2023, the company failed to ensure daily inspections were being done on forklifts, to ensure the PIV's were in a safe operating condition. b) On or about January 5, 2023 the company failed to ensure daily inspections were being done on order pickers, to ensure the PIV's were in a safe operating condition. c) On or about January 5, 2023 the company failed to ensure daily inspections were being done on power jack lifts, to ensure the PIV's were in a safe operating condition.
