29 CFR 1926.251(a)(1):Rigging equipment for material handling was not inspected prior to use on each shift and as necessary during its use to ensure that it was safe: At the Northside: On or about January 5, 2023, employees exposed to a struck-by hazard while operating a Sunstate Forklift to transport and hoist equipment to the work area did not have a qualified person to check for the proper use of a four-leg sling which was hitched onto a fork, incorrectly.

29 CFR 1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced. On or about January 5, 2023 and times prior thereto, workers were exposed to a struck by hazard from Sunstate rough terrain forklift that was carrying load (cement trolley machine) using a four legged sling and hook for hoisting to one fork (free rigging).
