29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who has authorization to take prompt corrective measures to eliminate them: a) 656 Sunset Blvd, Cape May, NJ - The employer did not ensure the competent person, lead foreman, access the site with inspections to identify existing and predictable hazards in the surroundings that may be encountered in the drilling process which are dangerous to employees. An employee for the company suffered severe leg injuries, leg amputation, when the employees leg was caught in an existing underlying wire fence and drug into the point of operation of the rotating auger. Noted on or about January 4, 2023. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: a) 656 Sunset Blvd, Cape May NJ - The employer did not train employees in the safe handling and operation of the TORO TX525 compact utility loader and to recognize the hazards that may be encountered in the drilling process. An employee working for the company suffered severe leg injury, right leg amputation, when the employees leg was caught in an existing underlying wire fence and drug into the point of operation of the rotating auger. This condition was noted on or about January 6, 2023. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
