29 CFR 1926.453(b)(2)(v): Employer failed to ensure a lanyard attached to the boom or basket when working from an aerial lift. On or about January 6, 2023, and at times prior thereto, employees used an aerial lift to paint and chalk the exterior of an apartment complex under construction without being attached to the boom basket, exposing the employees to the hazard of falling up to approximately 35 feet to the ground below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access. On or about January 6, 2023, two employees were using a ladder to climb from the front to the balcony of an apartment under new construction and the ladder side rails were not extended at least three feet above the lip of the roof, exposing employees to fall hazards.
