OSH ACT of 1970 Section (5)(a)(1) The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees The employer did not provide, and ensure each employee uses, a safe means of access and egress to and from walking-working surfaces. a. Knife Machine glue platform - On or about January 9, 2023, employees engaged in adjusting the glue manifold which requires the employees to bypass the guard rail system over the knife machine, exposing employees to fall and caught in hazards. a. Knife Area - On or about January 9, 2023, employees were required to climb on the table for the purpose for set up without being provided a means of access and egress onto the 42.5" table deck, exposing employees to a fall hazard. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.28(b)(6)(i): The employer did not ensure that each employee less than 4 feet (1.2 m) above dangerous equipment is protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system, unless the equipment is covered or guarded to eliminate the hazard. a.
