29 CFR 1910.134(e)(1):General. The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. On or about April 18, 2023, employees were exposed to respiratory stressors associated with being allowed to voluntarily wear 3M Half-Face Respirator with filters. Employees are wearing the respirator to protect from exposure to welding fumes when welding on stainless steel. The employees were not medically evaluated to determine the employee's ability to use a respirator before the employee is fit tested, or required to use the respirator in the workplace. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

Hyster 50-Model S50XM, Serial # D187V33739B powered industrial vehicle was found to have a rear right tire in need of repair and the employer had not taken it out of service until restored to safe operating conditions. This item was corrected during inspection.

29 CFR 1910.1200(e)(1):Employer had not developed or implemented a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: North and South Side of Plant: On or about April 18, 2023, employees were exposed to welding fumes, lead, Iron (III) oxide, and hexavalent chromium. The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section, for labels and other forms of warning, safety data sheets, and employee information and how training will be met. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

Information and training may be designed to cover categories of hazards or specific chemicals. Employees are welding on stainless steel, aluminum, and steel on a daily basis. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
