29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person: a) On or about January 6, 2023, the employer did not ensure that scaffolding utilized on-site was designed by a qualified person. CSHO observed an individual working from a mobile scaffold approximately 10ft or greater in height from a platform made of lumber and plywood. No guarding or attachment to the forks was observed to be present in that scaffold platform.

29 CFR 1926.451(c)(2)(v): The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied: a) On or about January 6, 2023, the employer failed to ensure that the scaffold platform was secured to the forks prior to being used. CSHO observed a worker engaged in rough framing activities at heights approximately 10ft or greater utilizing lumber and plywood as a make-shift scaffold platform. No guarding or method of securing was present in the make-shift platform.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) On or about January 6, 2023, the employer failed to provide or implement a fall protection system to protect an individual working at heights greater than 10ft from a fall onto a lower level. A rough all-terrain forklift was utilized as a mobile scaffold utilizing plywood and lumber as a working surface. The working platform was not guarded nor was personal fall protection equipped during this activity.
