29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. Note: The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. a) 500 South Broad Street Middletown, DE 19709: On or about January 10, 2023, CSHO observed employees wearing N95, negative pressure, half-face respirators for entry into a restricted area [e.g. COVID-19 positive residents] of the long term care facility and confirmed the employees did not have a medical evaluation prior to required use of the N95 Model 3M 9210 respirators.
