29 CFR  1926.20(b)(2):  Accident prevention responsibilities.  It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.   On or about January 10, 2023, at 320 E Main Street in Hortonville, Wisconsin, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized electrical and fall from elevation hazards.

29 CFR  1926.451(f)(3):  Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.   On or about January 10, 2023, at 320 E Main Street in Hortonville, Wisconsin, a Skyjack 3219 Scissor Lift with damaged control cables exposing wire conductors was not inspected for visible defects by a competent person before the work shift.

29 CFR  1926.451(g)(1)(vii):  For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   On or about January 10, 2023, at 320 E Main Street in Hortonville, Wisconsin, employees were exposed to a fall hazard while using a Skyjack scissor lift to access/egress a roof surface at greater than 14 feet above surface level without connecting the gate chain to complete the guardrail system and when employees climbed over the guard rails to access the roof.

29 CFR  1926.501(b)(10):  "Roofing work on Low-slope roofs."  Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  On or about January 10, 2023, at 320 E Main Street in Hortonville, Wisconsin, employees were exposed to a fall hazard while working from a roof surface 17 feet above surface level without using fall protection equipment.
