29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Miguel O. Rodriguez, at the jobsite located at 6463 Grand Club Dr., Powell, Ohio 43065: On or about January 11, 2023, the employer did not ensure employees were utilizing eye protection while operating circular saws and pneumatic nail guns, thereby exposing employees struck-by hazards.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a) Miguel O. Rodriguez, at the jobsite located at 6463 Grand Club Dr., Powell, Ohio 43065: On or about January 11, 2023, the employer did not ensure fall protection was utilized by employees  engaged in framing activities to a two-story residential house, thereby exposing the employee to fall hazards greater than 19 feet.

29 CFR  1926.451(c)(2)(v): Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied.  a) Miguel O. Rodriguez, at the jobsite located at 6463 Grand Club Dr., Powell, Ohio 43065: On or about January 11, 2023, the employer permitted employees to work from a support scaffold platform of plywood that was not attached to the Genie GTH-1056 telescopic rough terrain forklift, thereby exposing the employees to fall hazards greater than 19 feet.
