29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) At Etowah Preserve, Lot 257, Dawsonville, GA: On or about January 9, 2023, an employee performing framing operations was observed as exposed to approximately 21-feett, 6-inch fall hazards, in that the employer did not stop the work and remove the employee from the hazard upon recognition of the fall hazard. b) At Etowah Preserve, Lot 257, Dawsonville, GA: On or about January 9, 2023 an employee was observed standing in an unprotected window exposed to approximately 14-foot fall hazards in that the employer did not ensure that all openings were guarded. Tomas Moreno-Vargas was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1314003, citation number 1, item number 1 and was affirmed as a final order on November 20, 2018, with respect to a workplace located at 209 Thimbleberry Drive, Black Mill Preserve Lot 95, DAWSONVILLE, GA 30534 .
