Employees walked in aisles near powered industrial trucks being operated with no clear delineation or marking to identify path of travel for equipment and personnel. The condition exposed employees to struck-by and caught-in-between hazards.

29 CFR 1910.178(o)(2): Only loads within the rated capacity of the truck shall be handled: (a)Hearthside Food Solutions, LLC dba Interbake Foods, LLC at One Devil's Food Way, North Sioux City, SD 57049: On or about and at times prior to January 9, 2023, the employer did not ensure forklift operators did not exceed the rated capacity of the Toyota (model # 8FGCU20) forklifts. An operator moved two stacked pallets of peanut butter weighing approximately 3,600 pounds. The rated capacity of the Toyota forklift is 2,200 pounds. This condition exposed employees working on Bakery Line One near forklifts operating in the adjacent narrow aisleway to struck-by and crushing hazards related to unsafe operation.

Employees with previous forklift experience completed formal instruction but were not provided the practical aspects of the training to fully assess an operator's performance. This condition exposed employees to unsafe operation.

Forklift operators lift double stacked pallets and and will travel backwards, not looking in the direction and ensuring a clear path of travel on narrow aisles near Bakery Line One. This condition exposed employees working on Bakery Line One, near the forklifts in the adjacent narrow aisleway to struck-by and crushing hazards related to unsafe operation due to not looking in the direction of travel to ensure there is a clear path of travel.

This condition exposed the employees to the hazards of being struck-by forklifts.

29 CFR 1910.303(g)(1)(i): Working space for equipment likely to require examination, adjustment, servicing, or maintenance while energized did not comply with the following dimensions (3 feet), except as required or permitted elsewhere in this subpart: (a)Hearthside Food Solutions, LLC dba Interbake Foods, LLC at One Devil's Food Way, North Sioux City, SD 57049: On or about and at times prior to January 9, 2023, the employer did not ensure employees were protected from electrical hazards in that, clearance around the electrical panel B-1 was less than that specified in Table S-1. Clearance space to B-1 electrical panel was impeded by pallets stored in front of the panel. This condition exposed employees to the hazard of electrical shock and burns. Abatement Note: (A)The depth of the working space in the direction of access to live parts may not be less than indicated in Table S-1. Distances shall be measured from the live parts if they are exposed or from the enclosure front or opening if they are enclosed; (B)The width of working space in front of the electric equipment shall be the width of the equipment or 762 mm (30 in.), whichever is greater. In all cases, the working space shall permit at least a 90-degree opening of equipment doors or hinged panels; and (C)The work space shall be clear and extend from the grade, floor, or platform to the height required by paragraph (g)(1)(vi) of this section. However, other equipment associated with the electrical installation and located above or below the electric equipment may extend not more than 153 mm (6 in.) beyond the front of the electric equipment.
