29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.   a) New townhome construction located on Lot #4 at 513 Fiery Warbler St, McDonough, GA 30253. The employer did not initiate or maintain a safety program to address and correct the hazards at the jobsite. Hazardous conditions observed by CSHO on 01/05/2023 included employee working without hard hats with overhead hazards.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) New townhome construction located on Lot #4 at 513 Fiery Warbler St, top plate: On or about 01/05/2023, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic nail guns, in that protective eyewear was not provided to employees engaged in framing activities while operating these tools.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a) New townhome construction located on Lot #4 at 513 Fiery Warbler St, McDonough, GA 30253, top plate. On or about 01/05/2023, and at times prior, the employer exposed employees to fall hazards of 10-feet, 9-inches to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities.

On or about January 05, 2023, the employer did not provide the OSHA 300 logs and the OSHA 300A forms to the CSHO within 4 hours of request.
