OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards: a) On or about December 20, 2022, near the south side of a construction site at 334 2nd Avenue South, Saint Petersburg, FL: the employer exposed employees to struck-by and crushing hazards, in that the employer did not ensure employees in the vicinity of a Moffett Truck Mounted Forklift were protected while unloading pallets of landscaping materials. An employee performing the duties of a "spotter" for the forklift operator failed to maintain a clear path of travel for the forklift when another construction worker walking across an adjacent off-site parking lot was injured after being struck by the forklift as it moved a pallet across the parking lot toward the south entrance gate of the work site.
