29 CFR  1926.20(b)(1):The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  On or about January 11, 2023 the employer D&N American Construction Inc. at jobsite located at 1610 Moore Rd. Avon OH 44011, did not have a plan or a program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls and struck by hazards during job site operations, decreasing the probability of employee injury or illness.

29 CFR  1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  On or about January 11, 2023 the employer D&N American Construction Inc. at jobsite located at 1610 Moore Rd. Avon OH 44011, did not ensure employees working from a Genie mobile scaffold (aerial lift) (model z-80/60/Serial Number 7085100251) were adequately trained in the recognition of hazards associated with this type of mobile scaffold. Untrained employees operating the unit in this condition were exposed to operational hazards, such as but not limited to, falls from height.

Avon OH 44011, did not have a fall protection training program in place to enable each employee to recognize the hazards of falling, and procedures to minimize these hazards. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury or illness.

Avon OH 44011, did not ensure that employee(s) operating an aerial lift donned and secured their personal fall arrest systems before operating a Genie mobile scaffold (aerial lift) (model z-80/60/Serial Number 7085100251). Employees performing roofing work activities on a commercial hotel structure were exposed to falls of 25ft or greater to the ground below.

29 CFR  1926.501(b)(11):Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  On or about January 11, 2023 the employer D&N American Construction Inc. at jobsite located at 1610 Moore Rd. Avon OH 44011, did not ensure that employees were adequately protected from fall hazards while conducting construction roofing activities. Employees were exposed to a 25 feet or higher fall hazard from the roof of the structure to the ground below. Employees were working atop a steep roof with a 6:12 pitch at the peak of the roof.
