29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels (dBA) measured on the A scale, or equivalently a dose of fifty percent: (a) On or about January 10, 2023 - Facility, an employee was exposed to intermittent noise levels at 63.19% of the allowable 8-hour time-weighted average level (TWA) or an equivalent level of approximately 86.6 dBA. Due to the extended shift, the OSHA allowable 8-hour TWA level of 85 decibels was reduced to 83.4 decibels based upon the 10-hour shift. The sampling was conducted for 459 minutes during one shift on February 9, 2023. A hearing conservation program had not been implemented.
