29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)JCJ Construction LLC at 7649 East 10th Street, Sioux Falls, SD 57110:  On or about and at times prior to January 12, 2023, the exposing employer did not ensure that frequent and regular site inspections were conducted.  This condition exposed employees to fall hazards, ladder hazards, and training hazards.

29 CFR  1926.1053(b)(13):The top or top step of a stepladder was used as a step:  (a)JCJ Construction LLC at 7649 East 10th Street, Sioux Falls, SD 57110:  On or about and at times prior to January 12, 2023, the employer did not ensure that employees did not use the top step of the eight-foot step ladder in that they were accessing the top plates and roof trusses of a residential property by using the top step of the Werner eight-foot A-framed step ladder. This condition exposed employees to fall hazards greater than eight feet.

This condition exposed employees to fall hazards due to improper use.
