29 CFR 1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) R C Anderson Contracting Inc., 1141 W Enclave Circle, Louisville, CO 80027: On or before January 12, 2023, and at times prior, employees of R C Anderson Contracting Inc. were not trained in the recognition and avoidance of unsafe conditions at the jobsite. Employees were not able to recognize or avoid unsafe conditions in the open excavation and were exposed to dangerous conditions such as working in an unprotected protected trench without the knowledge of how to avoid the hazards, or control or eliminate them.

(a) R C Anderson Contracting Inc., 1141 W Enclave Circle, Louisville, CO 80027: On or before January 12, 2023, and at times prior, employees were conducting site preparation work for a new residential build. Work included working in an excavation ranging from 8 to 12 feet deep with spoils piles around the perimeter of the excavation, less than 1 foot from the edge. This exposed the employees struck-by and/or cave-in hazards.

This exposed workers to cave-in hazards.
