29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment: (a)Sullivan, Incorporated at 3101 North 4th Avenue, Sioux Falls, SD 57117: On or about and at times prior to January 9, 2023, the employer did not ensure that employees were protected from potentially dangerous health hazards in that a job hazard assessment to determine appropriate personal protective equipment ("PPE") was not conducted for employees required to removed bat excrement from the workplace. This condition exposed employees to potential health hazards.

29 CFR 1910.141(a)(5): A continuing and effective extermination program was not instituted where rodents, insects, or other vermin were detected: (a)Sullivan, Incorporated at 3101 North 4th Avenue, Sioux Falls, SD 57117: On or about and at times prior to January 9, 2023, the employer did not ensure that employees were protected from exposure to rabies and other bloodborne viruses associated with transfer from bat excrement located in the warehouse area. This condition exposed employees to rabies and other known pathogens.
