29 CFR 1926.405(a)(2)(ii)(I): Flexible cords and cables shall be protected from damage. Flexible cords and cables may pass through doorways or other pinch points, if protection is provided to avoid damage.  a) On or about 01/12/2023, at the "Splash Car Wash" located on 40 Nichols Street, in Spencerport New York, the employer did not enforce electrical safe work practices to ensure electrical cords that were in use were protected from damage.  The employer allowed employees to use cords without visual inspection which were exposed to damage from being driven over by vehicles entering the car wash bay.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR  1926.501(b)(11):"Steep roofs." Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toe boards, safety net systems, or personal fall arrest systems.  a)  On or about 01/12/2023, at the "Splash Car Wash" located on 40 Nichols Street, in Spencerport, New York, the employer did not enforce the use of fall protection.  Employees were allowed to install metal roofing panels 16 feet above lower levels without the use of fall protection and were exposed to fall hazards.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR  1926.1053(b)(4):Ladder(s) were used for purposes other than the purpose for which they were designed.  Portable step ladders most have  a metal  spreader or locking device engaged to hold the front and back sections in an open position during use.  a)  On or about 01/12/2023, at the "Splash Car Wash" located on 40 Nichols Street, in Spencerport, New York, the employer did not enforce safe ladder use during the installation of exterior framing.  The employer allowed employees to use a portable ladder designed to be used in an open position without using a locking device to keep the ladder in an open position and exposing them to  falls.  NO ABATEMENT CERTIFICATION REQUIRED
