29 CFR  1917.112(c)(3):The top surface of guardrails installed before October 3, 1983, shall be at least 36 inches (0.91 m) high. Those installed after October 3, 1983, shall be 42 inches (1.07 m), plus or minus 2 inches (5.1 cm), high.  a) At the company's dock area of Sause Bros, located at 3710 NW Front Ave., Portland OR, on or about January 13, 2023 and at times prior there to, the height of the top-rail of the chain guardrail system on the Southeast edge of the dock, was less than 36 inches.  An employee standing or walking near the edge could be expose to a fall of approximately 20 feet to the "floater's" metal deck below, suffering fractures, internal injuries or death, if the lean on the loose chain or slip or trip and fall over the defective chain railing system.   b) At the company's dock area of Sause Bros, located at 3710 NW Front Ave., Portland OR, on or about January 13, 2023 and at times prior there to, the height of a section of the top-rail of the guardrail system of the southwest edge, made of a round metal pipe approximately 2 1/2 inch in diameter inside another pipe, was less than 36 inches. An employee standing or walking near the edge could be expose to a fall of approximately 20 feet to the "floater's" metal deck below, suffering fractures, internal injuries or death, if the lean on the loose chain or slip or trip and fall over the defective chain railing system.

29 CFR  1917.112(c)(4): Non-rigid railing, such as chain or wire rope, had a maximum sag of more than 6 inches at the mid-point between posts.:   a) At the company's dock area of Sause Bros, located at 3710 NW Front Ave., Portland OR, on or about January 13, 2023 and at times prior there to, the height of the chain used as the top-rail of the guardrail system of the Northeast edge had a sag of 9 inches at the mid distance between posts.  An employee standing and leaning on the railing system or slip or trip as he/she walk near the edge could be exposed to a fall of approximately 20 feet onto the "floater's" metal deck below, suffering fractures, internal injuries or death.

An employee standing or walking near the edge could be expose to a fall of approximately 20 feet to the "floater's" metal deck below, suffering fractures, internal injuries or death, if the lean on the loose chain or slip or trip and fall over the defective chain railing system.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:   a) At the company's dock area of Sause Bros, located at 3710 NW Front Ave., Portland OR, on or about January 13, 2023 and at times prior there to, the man-basket in service at the time of the inspection that, according to the employer's representatives, was only used to hoist materials and equipment to the vessels, did not have a tag attached to its main structure nor had a legible tag with the information required for its safe use, that included but was not limited to the safe load and weight. Employees could accidentally overload the lifting device or the crane due to the lack of the required information and being exposed to struck-by hazard from falling equipment or materials and suffer fractures, head injuries, in the event of equipment failure during lifting activities.

29 CFR 1910.303(b)(1): Electrical equipment was not free from recognized hazards that were likely to cause death or serious physical harm to employees:  a: At the Sause Bros., river dock located at 3710 NW Front Ave., Portland Oregon; On or about January 13, 2023 and at times prior thereto, the employer failed to ensure the ground-fault circuit-interrupter (GFCI) 125 volt, single-phase 20-ampere receptacle was in operational condition. GFCI in service in the dock was not operational and employees handling electrical cords and plugs or using electrical equipment outdoors, in a wet environment, could become the path to ground in the event of a fault, resulting in shock or electrocution.

A readily available portable or permanent ladder giving access to the water shall also be provided within 200 feet (61 m) of such work areas.  a) At Sause Bros. 3710 NW Front Ave. Portland OR, river dock; On or about January 13, 2023 and at times prior thereto, the employer failed to ensure that a life ring, with a line attached was readily available at the Northwest "floater" waterside work area where the employees' work.   b) At Sause Bros. 3710 NW Front Ave. Portland OR, river dock; On or about January 13, 2023 and at times prior thereto, the employer failed to ensure that a life ring, with a line attached was readily available at the Southeast "floater" waterside work area where the employees' work.   c)  At Sause Bros. 3710 NW Front Ave. Portland OR, river dock; On or about January 13, 2023 and at times prior thereto, the employer failed to provide a ladder access to and from the water and the "floaters" deck, where the employees walk and work.  Sause Bros.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1917.26(f), which was contained in OSHA inspection number 1345657, citation number1 item number 1and was affirmed as a final order on October 12th, 2018, with respect to a workplace located at 29191 Dike Rd., Rainier OR 97048.  Sause Bros.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1917.26(f), which was contained in OSHA inspection number 1456181, citation number 1, item number1 and was affirmed as a final order on February12,2020, with respect to a workplace located at 3710 NW Front Ave., Portland OR 97210.
