29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. Located at 3225 Blantons Pass, Lot 2394, Delaware, Ohio: On or about January 9, 2023, the employer did not ensure that employees operating pneumatic nail guns to frame in the first story of the residential house being built utilized eye protection measures. Employees were thereby exposed to eye injuries.  b.  Located at 3225 Blantons Pass, Lot 2394, Delaware, Ohio: On or about January 9, 2023, the employer did not ensure that employees operating portable circular saws to cut wooden materials utilized eye protection measures. Employees were thereby exposed to eye injuries.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step.  a. Located at 3225 Blantons Pass, Lot 2394, Delaware, Ohio: On or about January 9, 2023, the employer did not ensure that employees worked safely from ladders in that employees utilized the top rung/step of a stepladder and were thereby exposed to falls of approximately 6 feet to the ground below.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. Located at 3225 Blantons Pass, Lot 2394, Delaware, Ohio: On or about January 9, 2023, the employer did not ensure that employees were protected from falls to the unprotected basement below while they performed framing activities on the first floor. As a result, employees were exposed to fall hazards of approximately 9 feet.  b. Located at 3225 Blantons Pass, Lot 2394, Delaware, Ohio: On or about January 9, 2023, the employer did not ensure that employees were protected from falls from the top of the first story wall framing while installing framing materials. As a result, employees were exposed to fall hazards of approximately 9-18 feet.  Candido Garcia was previously cited for a Serious violation of this Occupational Safety and Health Standard, which was contained in OSHA inspection number 1572438, citation number 1, item number 3, and was affirmed as a final order on August 9, 2022, with respect to a workplace located at 128 Pickerington Ponds Road in Pickerington, Ohio where employees worked from the second story walls and roof without fall protection measures and were exposed to fall hazard of approximately 20 feet.
