29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: On January 13, 2023, employees of Hermelincio Coy Ical were removing and installing shingles on a residential building located at 302 West Walton Street, Warrenton, Missouri. On the Northside of the building, employees were working on the ground level cleaning up old roofing materials without donning protective helmets. Employees were exposed to falling objects from above, while other workers were on the roof with a variety of tools.

An employee using a pneumatic nail gun to install shingles on the West side of the building was not utilizing eye protection. The worker was exposed to a struck-by hazards from flying objects and ricochets.

Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest systems: On January 13, 2023, employees of Hermelincio Coy Ical were removing and installing shingles on a residential building located at 302 West Walton Street, Warrenton, Missouri. Employees performing the roofing work were not protected from falling by fall protection systems. The pitch of the roof was 6: 12 on the main roof and 8:12 over gables with a height of approximately 12 to 18 feet at the eave. The employees did not utilize approved guardrail systems, a safety net system, or a personal fall arrest system.

A ladder was placed on the Northeast side of the building and used to access the upper landing surface of the roof. The side rails of the ladder did not extend 3 feet above the upper surface.
