29 CFR  1910.178(p)(1):If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.  Employees engaged in forklift activities at 1302 Industrial Ave, North Platte, Nebraska 69101, were exposed to a defective forklift hazard in that employees were operating Toyota Electric Forklift Truck #15, model # 5FBE15, serial # 29237, that had leaking hydraulic fluid that was restricting the movement of the forks when the forks were elevated.
