29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary. At the worksite located at 1409 NW Aspen Circle, Grain Valley, Missouri: Employees were exposed to struck by and collapse hazards associated with working in an excavation. Employees working in an excavation with the spoil pile placed within two feet of the edge of the excavation without the use of a retaining device.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: At the worksite located at 1409 NW Aspen Circle, Grain Valley, Missouri: Employees were exposed to struck-by and collapse hazards associated with working in an excavation. Employees were installing utilities in an excavation without the use of an adequate means of protection against an excavation collapse.
