OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:  a) On or about 01/10/2023 at the Kenan Center located at 433 Locust St Lockport, New York; employees were placing tarps and sandbags and using a material/debris platform which was not attached to the forks of a forklift. The use of a material platform was not approved for use to lift personnel by the forklift manufacturer, exposing employees to a fall hazards.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  a)  On or about 1/10/2023, in the warehouse area, employer did not provide Power Industrial Vehicles (PIV) training to all workers in all shifts who operate forklift trucks. The extension cords were used to supply power to lighting and scoreboards since the permanent receptacle outlet in the area did not have enough outlets for all the devices which were plugged and in operation.
