29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employer.  (a)  On or about January 18, 2023, a competent person was on site but did not perform frequent and regular inspections of the job site to ensure that hazardous conditions were identified and corrected.  Employees were exposed to fall hazards from not implementing fall protection while working from the roof and improperly installed ladders for accessing the roof.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph         1926.501 (b):  (a) On or about January 18, 2023, employees conducting roof sheathing work on a 8:12 pitch roof were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately Ten (10)  feet seven (7) inches onto dirt, gravel, and building material on the South side of the structure , and eleven (11) foot, two inches on the East side of structure near the garage entrance.

29 CFR  1926.602(c)(1)(viii)(A): The industrial truck was not equipped with a safety platform/cage firmly secured to the lifting carriage and/or forks when used for lifting personnel:   (a) On or about January 18, 2023, employee (s) were working suspended from the forks of a JLG (model 6042) all terrain fork lift, while standing on a stack of  4 foot by 8 foot sheets of 3/4 inch thick decking material  that was laying on but not secured to the forks or lifting carriage of the  all terrain forklift. This exposed the employee(s) to a fall hazard to the lower level of approximately 14 feet.

29 CFR 1926.1053(b)(1): Where a portable ladder(s) was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    (a) On or about January 18, 2023, the Werner Extension  ladder erected on the East side of the structure, at the garage entrance, being used for access to the 8:12 pitched roof, did not extend at least three (3) feet above the landing edge, and/or was not secured to the structure when it was not sufficiently extended. This exposed employees accessing the roof  to a fall hazard of approximately 11 feet, two inches.  (b) On or about January 18, 2023, the Werner Extension  ladder erected on the East side of the structure, at  or near  the front door entrance, being used for access to the second floor window, did not extend at least three (3) feet above the landing edge, and/or was not secured to the structure when it was not sufficiently extended. This exposed employees accessing the roof  to a fall hazard of approximately 14 feet.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purpose for which they were designed:  (a) On or about January 18, 2023, an employee working outside a framed residential structure did not insure an eight (8) foot self supporting portable step ladder was used as designed. The eight (8) foot step ladder was left in the closed position and leaned against a wall while the employee used the ladder to reach above. This exposed employee to a tip and fall hazard.
