29 CFR  1926.152(c)(4)(i): Portable outdoor storage tank for flammable or combustible liquids was nearer than 20 feet from the building:  (a) Texas Road House Construction Site, Fort Campbell, KY - East side of building exterior: On or about 1/18/2023, and at times prior, the employer exposed employees to fire and explosive hazards, in that a 480 gallon, portable, outdoor fuel storage tank was placed 2.8 feet from the building while employees were working in close proximity to the unit.

29 CFR  1926.152(f)(3): Flammable liquids were used where there were open flames or other sources of ignition within 50 feet of the operation   (a) Texas Road House Construction Site, Fort Campbell, KY - East side of building exterior, approximately 30 feet from wall: On or about 2/17/2023, and at times prior, the employer exposed employees to fire and explosive hazards, in that  fuel storage tank had two batteries with exposed terminals directly on top of the tank.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a) Texas Road House Construction Site, Fort Campbell, KY - East side of roof: On or about 1/18/2023, and at times prior, the employer exposed employees to falls of 10.8 feet or greater from the roof, in that personal fall arrest system provided to employees did not protect employees from falls while they were attaching plywood paneling to the the truss framing.

29 CFR  1926.501(b)(4)(ii): Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes (including skylights) by covers:  (a) Texas Road House Construction Site, Fort Campbell, KY - Center, East side of building: On or about 1/18/2023, and at times prior, the employer exposed employees to physical injury from trip and fall hazards, in that a hole in the ground approximately 72" L x 60" W x 32" D, was not covered to prevent workers from stepping into or tripping over the opening.

29 CFR  1926.501(c)(1): When employees were exposed to falling objects, the employer did not erect toeboards, screens, canopy structures or barricades to prevent objects from falling from higher levels:  (a) Texas Road House construction site, East side of roof: On or about 1/18/2023, and at times prior, the employer exposed employees to injuries from falling tools and building materials, in that toeboards were not used to prevent objects such as tools and lumber from falling from the roof edge while employees were working below higher levels while other employees were actively working above them.
