29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a)Defense Commissary Agency Ellsworth Air Force Base at 2649 LeMay Boulevard, Building 3920, Ellsworth AFB, SD 57706: On or about and at times prior to January 11, 2023, the employer did not ensure that the Hobart Bone Saw, serial number: 311611882, model number: 6801, was equipped with a properly installed upper guide hand knob or otherwise protected from operator contact with the rotating band saw blade located on the south center side of machine. This condition exposed operators to caught-in and amputation hazards.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye: (a)Defense Commissary Agency Ellsworth Air Force Base at 2649 LeMay Boulevard, Building 3920, Ellsworth AFB, SD 57706: On or about and at times prior to January 11, 2023, the employer failed to report within twenty-four (24) hours after an in-patient overnight hospitalization of an employee due to an amputation while utilizing a Hobart Bone Saw, serial number: 311611882, model number: 6801. OSHA was not notified of this event until January 16, 2023 by the electronic notification system.
