On or about January 18, 2023, at 9004 Progress Way in Weston Wisconsin, employer did not initiate and maintain safety programs for employees exposed to fall hazards and operating equipment during a steel erection project.

29 CFR  1926.451(a)(1):  Except as provided in paragraphs (a)(2), (a)(3), (a)(4), (a)(5) and (g) of this section, each scaffold and scaffold component shall be capable of supporting, without failure, its own weight and at least 4 times the maximum intended load applied or transmitted to it.  On or about January 18, 2023, at 9004 Progress Way in Weston Wisconsin, employees climbed on the inside edge of a Skyjack scissor lift guardrail to access/egress the lift platform and a roof surface.  The guardrail was not designed to be a walking working surface.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   On or about January 18, 2023, at 9004 Progress Way in Weston Wisconsin, the employer did not provide required fall protection safety training for employees exposed to fall hazards greater than six feet while working on a roof installing floating, roof panels.

Note:  The requirements applicable to construction work under this paragraph are identical to those set forth at ��1910.178(l) of this chapter.  Reference:  29 CFR 1910.178(l)(4)(iii):  An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years.  On or about January 18, 2023, at 9004 Progress Way in Weston, Wisconsin; the employer did not ensure the JCB 550 170 Telehandler operator had a current performance evaluation within three years while utilizing the forklift to move construction materials on the worksite.

29 CFR  1926.453(b)(2)(v):  A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v):  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).   On or about January 18, 2023, at 9004 Progress Way in Weston Wisconsin, employees were exposed to a fall hazard greater than 20 feet while using a Genie S45 Telescopic boom lift without using required personal fall protection equipment.  The aerial lift was used to access/egress a roof surface.

Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  On or about January 18, 2023, at 9004 Progress Way in Weston Wisconsin, employees were exposed to a fall hazard while installing roof materials 25 feet above surface level without using required fall protection equipment.
