29 CFR  1910.147(c)(1):  The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  a)  Production Area:  On or about January 17th, 2023, and at times prior, the employer exposed employees to amputation hazards, in that a control of hazardous energy program was not implemented for employees who perform servicing and maintenance on machines including, but not limited to, the Repo Machine grinder.

29 CFR  1910.178(p)(1):  Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s)  a) Production Area:  On or about January 17th, 2023, and at times prior, the employer exposed employees to tip over/ struck-by hazards, in that the "Yale" model GLP 030VXNUSE084 forklift (serial number C810V03076E) was not taken out of service until unsafe operating conditions, including damaged/excessively worn tires and inoperative backup alarm were repaired where the forklift was used by employees to move plastic material.  b) Production Area:  On or about January 17th, 2023, and at times prior, the employer exposed employees to tip over/ struck-by hazards, in that the "Toyota" model 7EBCU25 forklift (serial number 66982) C810V03076E was not taken out of service until unsafe operating conditions, including damaged/excessively worn tires and inoperative backup alarm were repaired where the forklift was used by employees to move plastic material.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a)  Production Area:  On or about January 17, 2023, and at times prior, the employer exposed employees to chemical hazards, in that the employer did not develop and implement a written hazard communication program  for employees who are exposed to chemicals including, but not limited to, propane, hydraulic fluid, oil, while driving and maintaining forklifts.
