29 CFR 1910.132(d)(1):The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): OMNI POLYMERS INTL CORP. located at 1925 Nebraska Avenue in Toledo, Ohio: On or about January 19, 2023 the employer did not ensure that a hazard assessment was completed through a written certification that identified the workplace evaluated, the person certifying, and the date. Employees were exposed to hazards associated with residual, paints, citric acid, and sodium hydroxide found within 55 gallon plastic drums and 275 plastic totes such as, but not limited to, chemical burns and irritation to the eyes, skin, and respiratory tract.

29 CFR 1910.134(c)(2)(ii):The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: OMNI POLYMERS INTL CORP. located at 1925 Nebraska Avenue in Toledo, Ohio: On or about January 18, 2023 the employer did not implement elements of a respirator protection program necessary to ensure that employees using tight-fitting elastomeric respirators did so in a safe manner. Employees voluntarily wearing full and half face elastomeric respirators when handling chemical totes were not provided with a medical evaluation or trained on cleaning, storage and maintenance of an elastomeric respirator prior to use. Employees were exposed to hazards associated with cyclohexane, ethylbenzene, citric acid, and sodium hydroxide such as, but not limited to, drowsiness, dizziness, chemical burns, and irritation to the eyes, skin, and respiratory tract.

Employees processing and recycling plastic totes and barrels were provided with N95 disposable filtering facepiece respirators to wear on a voluntary basis. Employees were exposed to hazards associated with cyclohexane, ethylbenzene, citric acid, and sodium hydroxide such as, but not limited to, drowsiness, dizziness, chemical burns, and irritation to the eyes, skin, and respiratory tract.
