29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) On or about January 20, 2023, and at times prior, the employer did not administer a continuing, effective Hearing Conservation Program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. Employees sampled with the job title laborer, were exposed to noise levels exceeding the action level dose of 50%. The 4 laborers had noise exposure doses of 50.7%, 66.9%, 61.2%, and 64.1% which exceeded the action level dose of 50%.
