29 CFR  1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):   (a)  On or about November 1, 2022, Mezzanine - HVAC Unit Area: Employee was working approximately 7.5-feet above the lower level replacing the filter in the HVAC unit without any means of fall protection.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1910.36(d)(1): Employees were not able to open an exit route door from the inside at all times without keys, tools, or special knowledge. A device such as a panic bar that locks only from the outside is permitted on exit discharge doors.  (a)  On or about November 1, 2022, Warehouse: Employees worked in the warehouse gathering supplies where an emergency exit door was blocked with a Master resettable combination padlock secured from the inside.  No abatement certification or documentation required for this item.
