29 CFR 1910.30(a)(1) :(a) Fall hazards. (1) Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017. On or about January 20, 2023, at the facility located at 123 East Larsen Drive, Fond du Lac, Wisconsin; the employer did not ensure employees exposed to fall hazards of four feet or more were trained on the topics contained in 1910.30(a)(3)(i)-(iv).

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): On or about August 30, 2022, an employee was exposed to moving machinery hazards while engaged in cleaning activities on the Amada Band Sawing Machine (Model: P100C-Spartan, Serial No: P100C-110); also known as the Amada Cold Saw. The employer did not ensure that employees implemented energy control application steps or equivalent protective measures prior to allowing them to remove drops from the discharge chute. The machine was not deenergized prior to the employee engaging in the servicing/maintenance activity.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc. On or about August 30, 2022, an employee was exposed to moving machinery hazards on the Amada Band Sawing Machine (Model: P100C-Spartan, Serial No: P100C-110); also known as the Amada Cold Saw. The employer did not ensure moving machinery parts were adequately guarded to prevent employee contact.

29 CFR 1904.39(a)(3): You must report the fatality, in-patient hospitalization, amputation, or loss of an eye using one of the following methods: (i) By telephone or in person to the OSHA Area Office that is nearest to the site of the incident. (ii) By telephone to the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742). (iii) By electronic submission using the reporting application located on OSHA's public website at www.osha.gov. On or about August 30, 2022, at the facility located at 123 East Larsen Drive, Fond du Lac, Wisconsin; an employee suffered an amputation injury requiring OSHA notification within 24-hours. The employer failed to contact OSHA until approximately December 28, 2022.
