29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a) 320 S Market Street, Wilmington Delaware 19801 (Rooftop east side of Building): On or about January 20, 2023, and days prior, CSHO observed employees at the jobsite who worked to weatherproof the building and were exposed to fall hazards, caught -in/struck -by, or slip and trip hazards where there were not accident prevention programs in place.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) 320 S Market Street, Wilmington Delaware 19801 (Roof of Building): On or about January 20, 2023, CSHO observed employees walking along a unprotected edge at the jobsite, who worked to weatherize window openings and were not protected from falls by any means at heights of approximately 54 feet above ground level.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) 320 S Market Street, Wilmington Delaware 19801 (Roof of Building): On or about January 20, 2023, CSHO observed employees at the jobsite who worked to weatherproof the building who were not instructed in the recognition and avoidance of hazards including applicable regulations on the site at 320 S Market Street, Wilmington Delaware 19801 which resulted in employee's exposure to multiple hazards.   Abatement Note: The training program must enable the employees to recognize the hazards of falling and must train each employee in the procedures to be followed in order to minimize these hazards. Each employee must be trained by a competent person in the following: 1. The nature of fall hazards in the work area. 2. The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; 3. The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; 4. The role of each employee in the safety monitoring system when this system is used; 5. The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; 6. The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; 7. The role of employees in fall protection plans; 8. The standards contained in this subpart. The employer must verify compliance with paragraph (a) of this section by preparing a written certification record that will contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.
