29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a) Worksite - Materials Yard: On or about 1/24/2023, a powered industrial truck operator lifted an employee approximately 6 feet above the ground level with a Mitsubishi FG30N PIT, using a pallet as a platform without the benefit of fall protection for the hoisted employee.

29 CFR 1910.178(l)(4)(ii)(A): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required after an operator was observed to operate the vehicle in an unsafe manner to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely. (a) Worksite - Materials Yard: On or about 1/24/2023, a powered industrial truck operator was not provided refresher training after being observed raising an employee on a pallet to perform an assigned work task without any means of fall protection.
