29 CFR 1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. (a) On January 24, 2023, located on an urban road at site address 10511 Pippin Rd., Cincinnati, OH, employees were exposed to struck-by hazards as the employer did not have a Temporary Traffic Control Plan for working safely in or near the roadway construction to promote roadway safety to employees and provide warning and guidance needed for the reasonably safe, uniform, and efficient operation of all elements of the traffic stream.

29 CFR 1926.200(g)(2): All traffic control signs or devices used for the protection of construction workers shall conform to Part VI of the Manual of Uniform Traffic Control Devices (AMUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA, which are incorporated by reference. On January 24, 2023, located on an urban road at site address 10511 Pippin Rd., Cincinnati, OH, employees were performing flagging operations during a traffic control work zone were exposed to struck-by hazards while not utilizing the appropriate devices such as STOP/SLOW paddle that conform to Part VI of the Manual of Uniform Traffic Control Devices.

On January 24, 2023, located on an urban road at site address 10511 Pippin Rd., Cincinnati, OH, employees were exposed to struck-by hazards by moving vehicular traffic while performing traffic control operation while not utilizing the appropriate devices such as STOP/SLOW paddle in that the employer did not ensure employees had received instructions on applicable procedures or regulations to minimize the hazards associated with flagging operations.
