29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section. The employer failed to provide abatement documentation for the citation items 1-1, 1-2, 1-3-a, and 1-3-b, issued May 18, 2023, regarding the employer not completing worksite inspections, workers not wearing fall protection in an aerial lift, workers not protected from falls, and the point of attachment to a body belt shall be on the wearer's back.

On or about January 24, 2023, at the worksite located at 1636 Hoffman Road, Green Bay, Wisconsin; the employer did not address construction hazards by having frequent and regular inspections of the worksite by a competent person to eliminate hazards to contractors on the project.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. On or about January 24, 2023, at the worksite located at 1636 Hoffman Road, Green Bay, Wisconsin; contractors riding in a SkyJack (Model No.: SJ45T, Serial No.: 98000343) were not wearing a body harness and lanyard attached to the boom or boom basket of the aerial lift used for access to the roof, exposing those contractors to potential falls of approximately 10-feet, eight-inches. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems. On or about January 24, 2023, at the worksite located at 1636 Hoffman Road, Green Bay, Wisconsin; contractors were installing sheeting on an approximately 6:12 pitch roof, without any form of fall protection while exposed to an approximate 10-foot, eight-inch fall.
