OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to thermal burn hazards from high temperature water. a) For the clean-in-place process in the syrup room, on or about 01/20/2023, the employer exposed maintenance employees to thermal burn hazards, in that, employees troubleshooting/observing CIP operational control valves were exposed to hot water discharge from drains at temperatures around 185 degrees Fahrenheit (70.8 degree Celsius) and high temperature piping.

29 CFR 1910.132(a):Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a) For the clean-in-place process in the syrup room, on or about 01/20/2023, the employer exposed maintenance employees to thermal burn hazards, in that, employees troubleshooting CIP control valves were not required to wear personal protective equipment that would protect them from the release of hot water through drain valves located in the area where they were working or from high temperature piping. Water temperature was around 185 degrees Fahrenheit (70.8 degrees Celsius).
