29 CFR 1910.95(d)(1):When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: On or about April 3, 2023, operators working on a one-man dismantler pallet machine and trim saw conveyor, were exposed to high noise levels equivalent or exceeding the 8 hour time weighted average (TWA) of 85 dBA and the employer did not ensure a noise monitoring program was implemented onsite for the following: a. On or about April 3, 2023, #1 dismantler operator was exposed to noise to 228.6% of the permissible daily dose, or an average sound level of 95.5 dBA, as measured over 513 minutes of sampling. This dose is equivalent to an 8 hour TWA exposure of 96.0 dbA. b. On or about April 3, 2023, #2 dismantler operator was exposed to noise at 221.3% of the permissible daily dose, or an average sound level of 95.3 dBA, as measured over 480 minutes of sampling. This dose is equivalent to an 8 hour TWA exposure of 95.7 dbA. c. On or about April 3, 2023, the trim saw conveyor operator was exposed to noise at at 147.1% of the permissible daily dose, or an average sound level of 96.2 dBA, as measured over 297 minutes of sampling. This is equivalent to an 8 hour TWA exposure of 92.8 dBA accounting for the period of 183 minutes unmonitored. No abatement certification or documentation required for this item.

29 CFR 1910.95(k)(1):The employer shall train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer shall institute a training program and ensure employee participation in the program: On or about April 3, 2023, operators working on a one-man dismantler machine and trim saw conveyor were exposed to high noise levels equivalent or exceeding time weighted average (TWA) of 85 dBA. The employer did not ensure training was provided on various elements of a hearing conservation program such as but not limited to, the effects of noise, hearing protection and audiometric testing for the following: a. On or about April 3, 2023, #1 dismantler operator was exposed to noise to 228.6% of the permissible daily dose, or an average sound level of 95.5 dBA, as measured over 480 minutes of sampling. This dose is equivalent to an 8 hour TWA exposure of 96.0 dbA. b. On or about April 3, 2023, #2 dismantler operator was exposed to noise at 221.3% of the permissible daily dose, or an average sound level of 95.3 dBA, as measured over 480 minutes of sampling. This dose is equivalent to an 8 hour TWA exposure of 95.7 dbA. c. On or about April 3, 2023, the trim saw conveyor operator was exposed to noise at at 147.1% of the permissible daily dose, or an average sound level of 96.2 dBA, as measured over 297 minutes of sampling. This is equivalent to an 8 hour TWA exposure of 92.8 dBA accounting for the period of 183 minutes unmonitored. The employer did not establish a valid baseline audiogram against which subsequent audiograms can be compared for these employees. a. On or about April 3, 2023, #1 dismantle operator was exposed to noise to 228.6% of the permissible daily dose, or an average sound level of 95.5 dBA, as measured over 480 minutes of sampling. This dose is equivalent to an 8 hour TWA exposure of 96.0 dbA. b. On or about April 3, 2023, #2 dismantler operator was exposed to noise at 221.3% of the permissible daily dose, or an average sound level of 95.3 dBA, as measured over 480 minutes of sampling.
