29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: (a) On or about January 25, 2023, the employer did not ensure that each employee used a stepladder for which it was designed in that employees traded off using a stepladder to apply adhesive to second floor balconies. The employees placed one foot on the stepladder and their other foot on a balcony railing. This condition exposed employees to fall hazards of 10 feet and 3.5 feet.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would train each employee in the procedures to be followed to minimize hazards related to ladders and stairways: (a) On or about January 25, 2023, the employer did not provide a training program for each employee using ladders in that that each employee used a stepladder for which it was designed in that employees traded off using a stepladder to apply adhesive to second floor balconies. The employees placed one foot on the stepladder and their other foot on the balcony railing. This condition exposed employees to fall hazards of 10 feet and 3.5 feet.
