29 CFR  1910.147(c)(6)(i):The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed.  a. On or about January 27, 2023, and at times thereto, the employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedures and the requirements of this standard were being followed. Employees were engaged in maintenance activities on machinery including but not limited to shear presses which required the use of hazardous energy control. An inspection of the hazardous energy control program/procedures had not been performed to ensure adequacy and proper application. The following condition exposed employees to caught-in and struck-by hazards

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  a. On or about January 27, 2023, and at times thereto, employees were exposed to machine hazards associated with moving parts during servicing and maintenance activities on machinery which included but is not limited to shear presses. The employer failed to implement energy control application steps as LOTO devices were not applied to the electrical disconnect [per the 1910.147(d)(4) requirements] and blocks were not installed. As a result, the remaining applicable energy control elements, involving dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards. The following condition exposed employees to caught-in and struck-by hazards.

29 CFR  1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  a. On or about January 27, 2023, and at times thereto, employees were exposed to machine hazards associated with moving parts. Employees are exposed to the point of operation of the shear presses while holding and cutting catalytic converters without any means of guarding. As a result, the employer exposed employees to a caught-in hazard.  Legend Smelting and Recycling Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1506556, citation number 1, item number 1 and was affirmed as a final order on March 18, 2021, with respect to a workplace located at 717 O'Neil Drive, Hebron, OH 43025.
