29 CFR  1926.451(g)(1): Scaffolds. Fall protection. Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  a) On or about on January 24, 2023, an employee was working on the top planks of a Fabricated Framed Scaffold system to conduct siding and carpentry work on the front building of a new commercial property. The employee was exposed to a fall hazard not utilizing any fall protection system, while working above 17 ft. from the ground.

29 CFR  1926.453(b)(2)(v): Aerial Lifts. Specific requirements. Extensible and articulating boom platforms. A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  a) On or about January 24, 2023, the employer did not ensure employees who were operating a Sky Jack SJ66T Articulating Boom Lift to conduct carpentry and siding work on a commercial building were utilizing a harness with a lanyard attached to the boom or basket.

29 CFR 1926.454(a): Scaffolds. Training requirements. The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:  a) The nature of any electrical hazards, fall hazards, and falling object hazards in the work area; b) The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used; c) The proper use of the scaffold, and the proper handling of materials on the scaffold; d) The maximum intended load and the load-carrying capacities of the scaffolds used;   a) On or about January 24, 2023, employees were operating Sky Jack SJ66T Aerial Lift and, working from a Fabricated Framed Scaffold had not received training by a qualified person to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The potential fall hazard was calculated at 17 ft. from the ground.
