29 CFR  1926.102(a)(1): 29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a)  On a roof at a residence located at 3515 NW 21st Terrace, Cape Coral, Florida - On or about 01/27/2023, the employer exposed employees to eye injuries, in that eye protective equipment was not utilized by employees while using pneumatic nail guns to install asphalt shingles to roof.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)  On a roof at a residence located at 3515 NW 21st Terrace, Cape Coral, Florida - On or about 01/27/2023, the employer exposed employees to a fall hazard while using a Werner Multi Position Pro ladder that was installed at the roofs edge with the side rails less than 3 feet above the upper surface landing.

29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels were not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.   (a)  On a single story roof at a residence located at 3515 NW 21st Terrace, Cape Coral, Florida - On or about 01/27/2023, the employer exposed employees to a 10 foot fall hazard, in that fall protection was not utilized by employees while installing asphalt shingles on a 5:12 pitch roof.  The Nastar Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501 (b)(01), which was contained in OSHA inspection number 1379852 citation number 01, item number 01 and was affirmed as a final order on 09/11/2019, with respect to a workplace located at 1322 La Fraunce Way Fort Myers, FL  33919.
