29 CFR 1926.1412(d)(1)(viii): Electrical apparatus's were not inspected for malfunctioning, signs of apparent excessive deterioration, and dirt or moisture accumulation during the shift inspections: On or about January 25, 2023 and at times prior thereto, during the shift inspection, electrical wiring in the cab of the Terex American HC 165 lattice boom crane was not inspected for an electrical cable marked as a "hot wire". This exposed the employees to electrical and struck by hazards during crane operations.

On or about January 25, 2023, and at times prior thereto, small LP-gas containers stored at the cab floor of the Terex American HC165 lattice boom crane, were not stored in a suitably ventilated enclosure, and exposed employees to fire hazards.

29 CFR 1926.1416(b): Operations began when the listed operational aids were not in proper working order, where an operational aid was being repaired the employer used specified temporary measures. The time periods permitted for repairing defective operational aids were not in accordance with paragraphs (d) and (e) of this section. a. On or about January 25, 2023 and at times prior thereto, a Terex American HC 165 lattice boom crane lacked a working load weighing device, was used with temporary alternative measures, and the load weighing device was not repaired no later than 30 calendar days after the deficiency occurred. This exposed employees to struck by hazards hazards during crane operations. b. On or about January 25, 2023 and at times prior thereto, a Terex American 275 lattice boom crane lacked a working load weighing device, was used with temporary alternative measures, and the load weighing device was not repaired no later than 30 calendar days after the deficiency occurred. This exposed employees to struck by hazards hazards during crane operations.
