29 CFR 1910.94(a)(5)(iii): Properly fitted particulate filter respirators, commonly referred to as dust-filter respirators, may be used for short, intermittent, or occasional dust exposures such as cleanup, dumping of dust collectors, or unloading shipments of sand at a receiving point, when it is not feasible to control the dust by enclosure, exhaust ventilation, or other means. The respirators used must be approved by NIOSH under 42 CFR part 84 for protection against the specific type of dust encountered. a. On or about January 30, 2023, the employer did not provide respirators to employees working in hazardous atmospheres while grinding spic casing and tubing, medium-carbon alloy steel pipes b. On or about January 30, 2023, the employer did not provide respirators to employees working in hazardous atmospheres while blasting aluminum oxide pipes c. On or about January 30, 2023, the employer did not provide respirators to employees working in hazardous atmospheres while cleaning pipes and cleaning the N-7 building after grinding and blasting process

29 CFR 1910.1000(a)(2): Other substances -- 8-hour Time Weighted Averages. An employee's exposure to any substance in Table Z-1, the exposure limit of which is not preceded by a "C", shall not exceed the 8-hour Time Weighted Average given for that substance any 8-hour work shift of a 40-hour work week. On or about January 30, 2023, an employee grinding and blasting inside building N-7 and acting as an attendant for grinding and blasting was exposed to respirable nuisance dust in excess of the 8-hour time weighted average limit (TWA) for the permissible exposure limit provided in Table Z-1: a. An employee performing blasting and grinding duties was exposed to an 8-hour TWA for respirable nuisance particles of approximately 86 milligrams per cubic meter air during a 427 minutes sampling period. This exposure level was approximately 17.2 times the calculated permissible exposure limit of 5.00 milligrams per cubic meter air.
